TERMS AND CONDITIONS FOR BARTENDERS (BARTENDER TERMS)

The Bartender Terms govern the relationship between you, the bartender, and Set The Bar Pty Ltd (Set The Bar). Please read the Bartender Terms carefully before completing your registration and creating your account. If you have any questions, don’t hesitate to contact Set The Bar for clarification. By creating an account, you agree to be bound by these terms.

1. Role of Set The Bar

1.1 Set The Bar acts as a facilitator only. Our role is to assist you in finding positions with suitable event hosts (Hosts).

1.2 Set The Bar does not employ you. Your agreement for the provision of services is with the Host.

2. Your Obligations

2.1 You must provide accurate and complete information when creating your account and registering your experience on the Set The Bar website.

2.2 By creating an account, you consent to Set The Bar’s use of your information in accordance with our Privacy Policy, available at https://setthebar.com.au/privacy-policy/

2.3 It is your responsibility to negotiate the terms of your engagement with the Host. You must also make inquiries about the nature of the event and ensure you are comfortable with providing services at the event.

2.4 You must not agree to provide services at multiple events if they occur simultaneously or overlap unreasonably.

2.5 You are responsible for complying with all legal obligations, including tax requirements and responsible service of alcohol regulations.

2.6 A commission fee of 5% will be deducted from your earnings for each job. This percentage may vary based on your performance and compliance with Set The Bar’s policies.

3. Termination

3.1 Set The Bar may terminate this agreement immediately if you breach any term of this agreement.

3.2 If your account is terminated, Set The Bar will notify the Hosts with whom you have contracts, and they will decide whether to continue engaging your services.

4. Liability

4.1 Set The Bar excludes all implied terms and warranties to the extent permitted by law.

4.2 Set The Bar will not be liable for any special, indirect, or consequential loss or damage arising from your use of our services.

5. General

5.1 These terms are governed by the laws of Australia and the parties submit to the exclusive jurisdiction of the courts of Australia.

5.2 If any part of these terms is deemed illegal or unenforceable, it will be severed from the agreement without affecting the remaining provisions.

5.3 Any amendments to these terms must be made in writing and signed by both parties.

5.4 These terms constitute the entire agreement between you and Set The Bar regarding your use of our platform.


ORGANISER TERMS AND CONDITIONS

These Organiser Terms govern the relationship between you (the “Organiser”), being the person or entity requesting services, and Set The Bar Pty Ltd (referred to as “Set The Bar”, “we”, “us” or “our”). Please read these terms carefully before creating an account or requesting services. By using our platform, you agree to be bound by these Organiser Terms.


1. ROLE OF SET THE BAR

1.1 Set The Bar acts as a facilitator to help Organisers connect with available, independent staff.

1.2 Set The Bar does not employ staff. You contract directly with the staff you select.


2. YOUR OBLIGATIONS

2.1 You must provide accurate, honest, and complete information at all times—including when creating an account, listing an event, or communicating with staff.

2.2 Information you provide may be used in accordance with our Privacy Policy, which is available on our website at https://setthebar.com.au/privacy-policy/

2.3 A non-refundable deposit is payable upon event registration. This is charged to the card you provided when creating your account. Deposits remain non-refundable even if the event is cancelled or postponed due to circumstances outside your control.

2.4 You are solely responsible for negotiating your agreement with staff. This includes checking qualifications, references, and suitability. Set The Bar does not vet or verify staff credentials or backgrounds and accepts no responsibility if the staff do not meet your expectations.

2.5 You acknowledge and accept that you may be responsible for certain legal obligations regarding employment laws, insurance, tax, and compliance (e.g., working with children, alcohol licensing). These obligations rest solely with you, and Set The Bar will not be liable for any breaches.

2.6 If your event date changes, your deposit will carry over. However, cancellation or rescheduling fees may still apply depending on your agreement with the staff.

2.7 If staff arrive at the listed event location and you are not present or fail to respond to communication, you will be charged the full job amount.

2.8 You agree not to bypass the platform. Contacting staff directly for bookings outside the platform (including via SMS, email, Instagram, Facebook, etc.) will incur a $75 fee per breach, per staff member.

2.9 Cancellation Fees:

  • Within 48 hours of the scheduled start: 50% of staff fees will be charged (staff receive a minimum of $50).
  • Within 5 hours of the start: 100% of staff fees will be charged (staff receive a minimum of $100).
  • If staff show up ready to work and are turned away or ignored, 100% of their fee is charged.

3. AGREEMENT WITH STAFF

3.1 While Set The Bar is not a party to your contract with staff, you are required to include, at a minimum, the following in writing (e.g., via email or chat):

  • (a) Event date
  • (b) Nature of the event
  • (c) Venue address
  • (d) Staff arrival and expected finish time
  • (e) Agreed pay rate (not less than the minimum advertised on the platform)
  • (f) Payment method and timing
  • (g) Cancellation or postponement terms
  • (h) Reimbursement details (e.g., travel or other reasonable expenses, if applicable)

4. TERMINATION

4.1 We reserve the right to immediately terminate your account or access if you breach these terms. In such cases, staff you have engaged will be notified and may choose to proceed independently under their agreement with you.

4.2 No refunds will be issued on deposits if your access is terminated due to breach.


5. LIABILITY

5.1 Except where prohibited by law, all implied conditions and warranties are excluded.

5.2 Set The Bar is not liable for any indirect or consequential loss, including lost profits or personal injury, resulting from your use of our platform or services.

5.3 Our total liability to you is limited to the amount paid by you for the specific services that gave rise to the claim.

5.4 You agree to indemnify and hold harmless Set The Bar and its staff, agents, affiliates, and contractors from any third-party claims or losses resulting from your use of the platform or breach of these terms.


6. GENERAL

6.1 This agreement is governed by the laws of Australia, and parties submit to the exclusive jurisdiction of its courts.

6.2 If any part of this agreement is deemed unlawful or unenforceable, it will be severed without affecting the rest.

6.3 Changes to these terms must be made in writing and signed by both parties. Failure to enforce any provision will not be considered a waiver.

6.4 These terms represent the entire agreement between you and Set The Bar.
